1. BACKGROUND

1.1 Moufit DMCC is a DMCC Free Zone company incorporated under the laws of Dubai, United Arab Emirates with business licence number DMCC179386 (“MouFit”, “We”, “Our”, “Us”) and having its principal place of business at Office 106, The Binary, Al Abraj Street, Business Bay, P.O. Box 413383, Dubai, United Arab Emirates.

1.2 You are the natural person who is Using the Platform in Your own individual capacity and/or on behalf of a company (“You”).

1.3 Moufit is committed to protecting and respecting Your privacy when You use the Platform.

2. SCOPE OF PRIVACY POLICY

2.1 This Privacy Policy applies to:

2.1.1 all users of the Services;

2.1.2 all users of the Platform; and

2.1.3 anyone else who contacts or otherwise submits information to Moufit.

3. PRIVACY POLICY

3.1 This Privacy Policy sets out the basis upon which Moufit will process any Personal Information Moufit collects from You, or that You provide to Moufit.

3.2 This Privacy Policy also explains use of cookies on the Platform.

3.3 Please read this Privacy Policy carefully to understand Moufit’s views and practices regarding Your Personal Information and how Moufit will treat it.

3.4 By accessing and using the Platform and/or providing Us with Personal Information, You acknowledge and agree that You:

3.4.1 understand and unconditionally accept and agree to this Privacy Policy; and

3.4.2 consent to Moufit processing / using Your Personal Information in the manner set out in this Privacy Policy.

3.5 If You do not accept and agree to this Privacy Policy, please do not provide Your Personal Information to Moufit and do not interact with or use the Platform.

4. DATA / INFORMATION MOUFIT MAY COLLECT FROM YOU

4.1 Moufit may collect and process the following categories of information:

4.1.1 information You provide to Moufit when You create or update Your account with Moufit;

4.1.2 information You provide to Moufit as part of its background checks;

4.1.3 information You provide to Moufit when You access the Services via the Platform;

4.1.4 information You provide to Moufit when You contact Moufit, including without limitation to provide feedback or to request for assistance;

4.1.5 information You provide to Moufit when You contact other users through the Services;

4.1.6 information You provide to Moufit when You complete surveys sent to You by Moufit or on its behalf;

4.1.7 enable features that require Moufit’s access to Your address book or calendar;

Information created when You use Moufit’s Services / the Platform

4.1.8 Your precise or approximate location information as determined through data such as GPS, IP address and Wifi;

4.1.9 information about transactions made via use of the Platform;

4.1.10 information about how You interact with our Services, Your preferences and Your chosen settings;

4.1.11 technical information about the devices You use to access Moufit’s Services, including without limitation:

(a) hardware models;

(b) operating systems and versions;

(d) file names and versions;

(e) preferred languages;

(f) unique device identifiers;

(g) advertising identifiers;

(h) serial numbers;

(i) device motion information; and

(j) mobile network information;

4.1.12 information about Your use of the Platform, including without limitation:

(a) Your device IP address;

(b) Your access dates and times;

(d) pages You view;

(e) App crashes and other system activity;

(f) type of browser You use; and

(g) the third party website or service You were using before interacting with the Platform;

4.1.13 information about You that Moufit receives from third parties, including without limitation, from:

(a) other users of Moufit’s Services;

(b) payment service providers;

(d) insurance providers;

(e) advertising networks;

(f) analytics providers; and

(g) search information providers; and

4.1.14 Your Personal Information, including without limitation, Your:

(a) name;

(b) contact details (including without limitation physical and email addresses);

(d) personal description;

(e) photograph;

(f) date of birth / age;

(g) body measurements, dimensions and weight;

(h) medical history;

(i) preferred fitness / training disciplines;

(j) location; and

(k) health app statistics.

5. COOKIES

Moufit’s Cookies

5.1 A cookie is a piece of data stored on Your browser or device by websites, applications, online media and advertisements containing non-personally identifiable information about You.

5.2 The Platform uses cookies to distinguish You from other users. This helps Moufit provide You with a good experience when You use the Platform and also allows Moufit to improve them.

5.3 MouFit uses cookies to collect information about individual user behaviour on the Platform. Moufit uses the following cookies:

5.3.1 Strictly necessary cookies – these are required for the operation of the Platform (including without limitation cookies that enable You to log into secure areas);

5.3.2 Analytical / performance cookies – these are used to understand how users use the Platform and for Moufit to improve them, e.g. cookies that enable us to understand how You are using the Platform and its features;

5.3.3 Functionality cookies – these provide functionality that help Moufit deliver its Services, e.g. cookies that help You log in by pre-filling fields, cookies that enable Moufit to personalise its content for You, greet You by name etc; and

5.3.4 Targeting cookies – these cookies are used to test which online content and offers are more relevant to users, e.g. by recording Your access to the Platform, the webpages You have visited and the links You have followed.

Third Party Cookies

5.5 Moufit allows carefully selected third parties to place cookies via the Platform.

5.6 These third party cookies track Your use of the Platform by collecting anonymous statistics.

5.7 Moufit does not have access to or control over these cookies. Please consult the respective privacy policies of these third parties.

Cookie Blocking

5.8 You may block cookies by activating the setting on Your browser that allows You to refuse the setting of all or some cookies.

5.9 Please note that if You use Your browser settings to block all cookies, You may not be able to access all or parts of the Platform.

6. Uses made of the data / information

6.1 Moufit may use information held about You in the following ways:

6.1.1 to carry out Moufit’s obligations and to provide You with the information and/or Services that You request from Moufit;

6.1.2 to provide You, or permit selected third parties to provide You with information about services Moufit offers or feels may interest You;

6.1.3 to notify You about changes to the Services;

6.1.4 to ensure that content from the Platform is presented in the most effective manner for You and for Your device;

6.1.5 to administer the Platform and for internal operations, including without limitation troubleshooting, data analysis, testing, research, statistical and survey purposes;

6.1.6 to allow You to participate in interactive features of the Platform, when You choose to do so;

6.1.7 as part of Moufit’s efforts to maintain the safety, security and integrity of Moufit’s Platform and Services;

6.1.8 to deliver relevant advertising to You and measure or understand the effectiveness of the same;

6.1.9 to provide appropriate assistance to You when You contact Moufit’s customer support;

6.1.10 for testing, research, analysis and product development; and

6.1.11 to investigate or address claims or disputes relating to Your use of the Services and/or Platform in accordance with applicable law.

7. Disclosure of your data / information

7.1 Moufit may share Your information with any of Moufit’s employees or independent contractors it works with to deliver the services You have requested from these third parties.

7.2 Moufit may share / disclose Your information with selected third parties, including:

7.2.1 people who Moufit works with, including without limitation Moufit’s Affiliates, employees, suppliers and sub-contractors for the performance of any contract Moufit enters into with You;

7.2.2 advertisers and advertising networks that require the data to select and serve relevant adverts to You and others;

7.2.3 analytics and search engine providers that assist Moufit in the improvement and optimisation of the Platform;

7.2.4 where Moufit sells or buys any business or assets, in which case it may disclose Your information to the prospective seller or buyer of such business or assets;

7.2.5 where Moufit is under a duty to disclose or share Your information in order to comply with any legal or regulatory obligation or order; and/or

7.2.6 in order to enforce or apply any of Moufit’s terms and conditions and/or to protect the rights, property or safety of any of Moufit’s employees or customers.

8. Where MOUFIT stores your personal data / information

8.1 The information that Moufit collects from You may be transferred to, and stored at, a destination outside the United Arab Emirates.

8.2 Your information may be processed by people outside the United Arab Emirates who work for Moufit or Moufit’s suppliers. Such staff may be engaged in, among other things:

8.2.1 the provision of services;

8.2.2 the processing of Your payment details; and/or

8.2.3 the provision of support services.

8.3 By submitting Your information, You agree to the information transfer, storing or processing referred to in this Privacy Policy.

8.4 Unfortunately, the transmission of information via the internet is not completely secure and any transmission of data / information is at Your own risk.

8.5 Moufit will take all commercially reasonable steps, which are necessary to ensure that Your information is treated securely and in accordance with this Privacy Policy.

8.6 Notwithstanding Clause 8.5, Moufit cannot guarantee the security of Your information transmitted to the Platform.

8.7 Where You have a password which enables You to access certain parts of the Platform, You are responsible for keeping this password confidential and agree not to disclose it to anyone.

9. Your rights

9.1 You have the right to ask Moufit not to process Your information for marketing purposes.

9.2 Moufit will usually inform You (before collecting Your information) where it intends to:

9.2.1 use Your data for marketing purposes; or

9.2.2 disclose Your information to others for marketing purposes.

9.3 You can also exercise Your right at Clause 9.1 at any time by contacting Moufit at yalla@mou.fit.

9.4 The Platform may, from time to time, contain links to and from third party websites.

9.5 If You follow a link to / from any third party websites, You do so at Your own risk, and subject to whatever privacy policy / website terms that govern the use of such websites.

9.6 Moufit does not accept responsibility or liability for the content of third party websites, or any information You provide to them.

10.1 Any changes Moufit may make to this Privacy Policy will be posted on this page. Please check back frequently to see any updates or changes.

10.2 Your continued use of the Platform will confirm Your understanding and acceptance of this Privacy Policy and any changes made to it from time to time.

12. DEFINITIONS

12.1 “Affiliate” means any entity that is Controlled by a Party or under common Control of that Party;

12.2 “App” means the moufit application downloadable via a relevant app store including those offered by Apple Inc. or Google Inc.

12.3 “Personal Information” means data relating to a living individual who is or can be identified either from the data or from the data in conjunction with other information that is in, or is likely to come into, Moufit’s possession.

12.4 “Privacy Policy” means this privacy & cookie policy.

12.5 “Platform” means the Site and/or the App.

12.6 “Services” means the technology platform that enables users of Users of the Platform to arrange and schedule personal training and fitness-related services with independent third party providers.

12.7 “Site” means the website at https://www.mou.fit/ae-en/.
